Freedom of religion exists under Section 2(a) of the Canadian Charter, so an argument based on appeal to authority (god) is not substantial. Whether something is biologically evolved should have no impact on the legality. Furthermore, it is discrimination based on sexual orientation, as marriage provides legal and financial benefits (e.g. tax loopholes), and should be available to all.
